English summary: Heinrich Lang studies the grounds for and the boundaries of legislation based on self-interest. It is the author's main contention that a government which is bound by the constitution is dependent on a distance between lawmakers and the subject of the law in order for it to be legitimate, and that this distance is not kept when decisions are made on one's own behalf. Using the present law for the remuneration of members of parliament as an example, the author begins by showing the weakness in those self-beneficial decision-making structures. In the section dealing with legal theory, he demonstrates that the structural deficits of decisions made on one's own behalf in a parliamentary democracy are not the result of a self-service mentality on the part of the members of parliament but rather the result of a self-service constellation. The author also shows how it is possible to re-establish the distance in the constitutional state and to keep the political parties financing law from becoming a subject of dispute. German description: In Verwaltung und Rechtsprechung gilt der verfassungs- und vielfach auch einfachgesetzlich normierte Grundsatz, dass niemand in eigener Sache entscheiden darf. Fur die Gesetzgebung fehlen scheinbar entsprechende Regelungen. Das wird vor allem im Bereich des staatlichen Politikfinanzierungsrechts zunehmend als offene Flanke des Verfassungsstaats empfunden. Heinrich Lang untersucht Grund und Grenzen eigeninteressierter Gesetzgebung. Verfassungsrechtliche gebundene Herrschaftsausubung, so die Hauptthese des Autors, ist legitimatorisch auf eine Distanz zwischen Entscheidungstrager und Entscheidungsgegenstand angewiesen, die bei Entscheidungen in eigener Sache verletzt wird. Am Beispiel des geltenden Abgeordnetenfinanzierungsrechts zeigt er zunachst in einer umfangreichen Analyse die strukturelle Schwache selbstbegunstigender Entscheidungsstrukturen auf. Das Fehlen wirksamer Kontrollmechanismen hat zu einer in weiten Teilen verfassungswidrigen Ausgestaltung des Abgeordnetenfinanzierungsrechts gefuhrt. Im rechtstheoretischen Teil wird gezeigt, dass die strukturelle Defizienz der Entscheidungen in eigener Sache in der parlamentarischen Demokratie nicht das Ergebnis einer Selbstbedienungsmentalitat der Abgeordneten, sondern einer Selbstbedienungskonstellation ist. Sie verweist auf einen Webfehler in der parlamentarischen Entscheidungsfindung. Wahrend die Durchsetzung astorender Sonderinteressen im Normalfall des parlamentarischen Reprasentationsprozesses durch den notwendigen Ab- und Ausgleich divergierender Interessen verhindert wird, fuhrt bei eigeninteressierter Gesetzgebung die Distanzlosigkeit zum Entscheidungsgegenstand zu defiztaren Ergebnissen. Der Autor zeigt auch Wege auf, wie die verfassungsstaatliche Distanz wiederhergestellt und gerade das Politikfinanzierungsrecht dem Streit entzogen werden kann.
