Studienarbeit aus dem Jahr 2015 im Fachbereich Geschichte Europa - and. Länder - Mittelalter, Frühe Neuzeit, Note: 1,3, Albert-Ludwigs-Universität Freiburg, Sprache: Deutsch, Abstract: In Fridankes Lehrgedicht "Bescheidenheit" wird bereits im Jahr 1230 die Erweiterung der herrschaftlichen Sphäre auf die Marknutzungsrechte der bäuerlichen Bevölkerung angeprangert. Über 200 Jahre später, zu Beginn des hier untersuchten Zeitraumes, ist diese Thematik immer noch hochaktuell. Anhand zweier Dokumente aus Hainstadt, einem Weistum aus dem Jahr 1448 sowie einer Dorfordnung aus dem Jahr 1589, soll in dieser Arbeit das Verhältnis der Bauern und der Herrschaft zum Wald, sowie zueinander, herausgearbeitet werden. Nach einer kurzen Vorstellung der Gemeinde Hainstadt im Mittelalter und des herrschaftlichen Kontextes, soll die Relevanz des Untersuchungsgegenstandes Wald verdeutlicht werden, indem die Nutzungsformen aufgezeigt werden. Dies geschieht mit direktem Bezug auf Hainstadt anhand der Analyse der beiden Quellen. Es folgen wichtige Hintergrundinformationen: Ein geschichtlicher Abriss zur Entwicklung des Waldes und der Waldwirtschaft sowie die Situation der Bauernschaft im Verlauf des Mittelalters. Anschließend werden die Konflikte, die um die Waldnutzung, auch speziell in Hainstadt, entstanden sind, dargelegt. Im nächsten Schritt wird wieder quellennah untersucht, wie sich die Nutzungsrechte der Hainstädter Bauern 1448 und 1589 unterschieden. Um diese Erkenntnisse einzuordnen und zu verstehen, wie sich das Tauziehen um den Hainstädter Wald abgespielt hat, werden abschließend die Einflußnahme der Herrschaft, wie auch der Protest der Bauernschaft, eruiert. Ein abschließendes Fazit soll die Ergebnisse der Arbeit prägnant zusammenfassen. Die meisten Konflikte konnten im Mittelalter durch Rückgriff auf Gewohnheitsrecht oder Verhandlungen beigelegt werden. Sonderfälle oder wiederkehrende Streitigkeiten fanden aber oft Niederschlag in Dokumenten, die uns heute als Quellen Einsic
