Inhaltsangabe: Gang der Untersuchung: Die Arbeit ist aus Gründen einer besseren Übersichtlichkeit in drei Teile gegliedert. Zunächst beschäftigt sich Teil A mit der Darstellung grundlegender Zusammenhänge. Im Zentrum stehen dabei begriffliche Abgrenzungen und Definitionen und eine Beleuchtung des Phänomens der "Abwesenheitsentscheidung". Anschließend findet eine kurze Zusammenfassung der gesetzlichen Regelungen zur Entgeltfortzahlung statt, auf die im weiteren Verlauf des öfteren zurückgegriffen wird. Teil B ist der eigentliche Kein der Arbeit. In jedem Kapitel wird ein Instrument vorgestellt, das dem Arbeitgeber zur Bekämpfung des Mißbrauchs zur Verfügung steht. Die Gewichtung der einzelnen Kapitel ist unterschiedlich. Sie hängt sowohl von der arbeitsrechtlichen "Ergiebigkeit" des jeweiligen Instruments als natürlich auch von meiner subjektiven Einschätzung über dessen Bedeutung ab. So nimmt das Krankengespräch und die ausführliche Erörterung der betriebsrätlichen Mitbestimmung ebenso wie das vom Gesetzgeber primär vorgesehene Instrument der Mißbrauchsbekämpfung, die Einschaltung des Medizinischen Dienstes, einen weitaus größeren Umfang ein als "Randerscheinungen" wie Krankenbesuche oder Detektiveinsätze. Die einzelnen Kapitel in Teil B unterscheiden sich in ihrer grundlegenden Struktur nicht wesentlich: Eingangs wird die jeweilige Maßnahme in ihren Grundzügen beschrieben. Dann folgt eine Erörterung der im Zusammenhang mit der Maßnahme relevanten arbeitsrechtlichen Aspekte. Hierbei steht vor allem die Frage, unter welchen Voraussetzungen die Anwendung eines Instruments zulässig ist, sowie die Mitbestimmung des Betriebsrats im Zentrum der Betrachtung. Am Ende jedes Kapitels wird untersucht, inwieweit und unter welchen Gegebenheiten die Durchführung der Maßnahme erfolgversprechend ist und welche Probleme sie ggf. mit sich bringen kann. Abschließend wird in Teil C die Quintessenz der durch diese Arbeit gewonnenen Erkenntnisse in knapper Form geschildert. Inhaltsverze
