Das Bürgerliche Gesetzbuch übernimmt diese Aufgabe mit dem § 611. Demnach besteht die Hauptpflicht seitens des Arbeitgebers darin, die "vereinbarte Vergütung" zu leisten. Im Gegenzug hierzu hat der Arbeitnehmer die dafür versprochene Arbeitsleistung zu erbringen. Die Personalentlohnung steht daher im Mittelpunkt. Mit ihr sollte jedoch nicht nur die Arbeitsleistung des Arbeitnehmers vergütet werden, sie hat auch die Aufgabe, dem Arbeitnehmer als Anreiz zu dienen. In jedem Fall ist es so, dass eine empfundene Lohngerechtigkeit starken Einfluss auf das Leistungsverhalten eines Arbeitnehmers hat. Denn wie Wöhe betont, begründet sich eine effiziente Leistungserstellung in der Motivation der Mitarbeiter (vgl. Wöhe, Günther 2000, S. 254). Aus betriebswirtschaftlicher Sicht hat der Arbeitgeber natürlich das Ziel der Gewinnmaximierung vor Augen. Dennoch lässt sich diese langfristig nur dann erreichen, wenn seine Lohnempfänger auch entsprechend zur Arbeitsbereitschaft motiviert sind. Hier sieht man deutlich, dass die beiden augenscheinlich gegnerischen Parteien, den als für beide Seiten gerecht empfundenen Lohn zum Ziel haben. Ein Arbeitsbewertungsverfahren, das von beiden Seiten als gerecht und sinnvoll empfunden wird, könnte diesen immerwährenden Konflikt zwischen Arbeitgeberverbänden und Gewerkschaften entschärfen. Die Arbeitsbewertung stützt sich dabei auf die Bewertung der Arbeitsschwierigkeit, unabhängig von der Person, die sie ausführt (vgl. Bisani, Fritz 1995, S. 439): Also wird die geforderte Arbeitsleistung somit normiert und der Mensch, welcher die Arbeit zu erbringen hat, wird zunächst nicht betrachtet.
