English summary: Since the decisions made by the European Court of Justice in the cases of Garcia Avello and Grunkin Paul, there has been a lively discussion in the literature of private international law on the recognition of civil and marital status within the European Union. There is also some talk of replacing traditional private international law with a basic recognition principle in European law. Katja Funken studies the extent to which European law, in particular the ban on discrimination and the freedom of movement, calls for a principle of mutual recognition in questions of status and asks whether or not mutual recognition as one of several possible methods of achieving the predetermined goal has to face the competition with other methods of private international law. On this basis, she studies whether it would be desirable to establish a recognition system for civil status in the entire European Union, and what the prerequisites for this would be. German description: Grundlagen und Grenzen einer Anerkennung von personen- und familienrechtlichen Statusverhaltnissen sind ein zentrales Thema der aktuellen Kollisionsrechtsdiskussion. Vor dem Hintergrund des Konflikts zwischen Stabilitat und Mobilitat ist der Konsens uber die Sachrichtigkeit kollisionsrechtlicher Antworten bruchig geworden. Katja Funken untersucht zunachst, ob das Gemeinschaftsrecht und dort insbesondere die Freizugigkeitsrechte eine Verkehrsfahigkeit von Statusverhaltnissen im Sinne einer Anerkennungspflicht auslandischer Statusverhaltnisse (Name, Ehe, eingetragene Lebenspartnerschaft, Abstammung, Adoption) bedingen. Auf der Basis der Analyse der einschlagigen Judikatur des EuGH deckt sie Verbindungslinien zwischen Gemeinschaftsrecht und Kollisionsrecht auf und verarbeitet diese. Den zweiten Themenschwerpunkt bilden Uberlegungen zur Standortbestimmung der Anerkennung im Rahmen der internationalprivatrechtlichen Methodik, insbesondere hinsichtlich des Verweisungsrechts und der Berucksichtigung statutsfremden Rechts auf Sachnormebene. Hier zeigt die Autorin, was die Anerkennung eines auslandischen Status kollisionsrechtlich zu leisten im Stande ist und was nicht. Zugleich beleuchtet sie die Rolle und Funktion von Statusverhaltnissen in den nationalen Rechtsordnungen. Den Abschluss der Untersuchung bilden rechtspolitische Uberlegungen zur Ausgestaltung einer Anerkennungsregel auf Ebene der EU. Insgesamt zeigt sich, dass der Gedanke der gegenseitigen Anerkennung die Technik der kollisionsrechtlichen Verweisung im Europaischen Rechtsraum keineswegs ablosen, aber sinnvoll erganzen kann.
