About the Book

La Constitución de Ecuador de 1869 fue la octava constitución ecuatoriana, vigente en el país durante el período comprendido desde 1869 hasta 1876, siendo después reemplazada por la Constitución de 1878. La Constitución de 1869 fue elaborada y propuesta por Gabriel García Moreno, a la cual sometió a un referéndum constitucional. La aprobó por el pueblo con un SÍ contundente.

La Constitución contiene trece títulos, además de disposiciones transitorias, que comprenden un total de 117 artículos.

Entre sus principales características constan


un período presidencial de seis años,

negación a la libertad de culto,

excesivos poderes por parte de la función ejecutiva,

cambio en los parámetros para ser ciudadano

y un mayor período de legisladores.

Permitió, además, que las fuerzas de seguridad pudieran entrar en cualquier domicilio. Estableció la pena de muerte por delitos de índole política y la limitación de los mandatos presidenciales a seis años, entre otros. Su carácter poco liberal provocó que fuera bautizada popularmente como Carta Negra.

De alguna manera, la Carta Negra fue una de las causas del descontento general que estalló el 6 de agosto de 1875. Terminando con la sangrienta ejecución de García Moreno.

García Moreno murió el 6 de agosto de 1875, a manos de uno de sus enemigos más acérrimos: Faustino Lemus Rayo. La desaparición de la figura de García Moreno marcó el inicio del debilitamiento de la hegemonía conservadora en el país.

Su sucesor fue Antonio Borrero, que pertenecía al Partido Progresista. En un primer momento mantuvo buenas relaciones con los liberales, pero su negativa a reformar la Carta Negra provocó que ambos bandos rompieran relaciones. Los liberales apoyaron entonces al general Ignacio de Veintimilla en su intento de golpe de Estado.

El triunfo de esta asonada llevó a Veintimilla al poder, primero como Jefe Supremo y después, tras aprobar una nueva Constitución, como Presidente constitucional.
