Ein Kernstück des deutschen Wettbewerbsrechts ist § 3 UWG, das allgemeine Verbot der irreführenden Werbung. Mit § 3 UWG werden europaweit die höchsten Anforderungen an die Lauterkeit der Werbung und den Schutz der Verbraucher gestellt. Die Autorin untersucht, ob der von der deutschen Rechtsprechung mit § 3 UWG praktizierte Lauterkeitsmaßstab europarechtskonform ist. Bei grenzüberschreitender Werbung steht das deutsche Regelungs- und Schutzinteresse insbesondere im Konflikt mit dem Grundsatz des freien Warenverkehrs. Der Betrachtung sekundärrechtlicher Vorschriften folgt die Analyse der Rechtsprechung des Europäischen Gerichtshofs zu Art. 30 EGV. Ergebnis der Arbeit ist, daß § 3 UWG in seiner Anwendung durch die deutsche Rechtsprechung ein verbotenes Handelshemmnis darstellt.
About the Author: Die Autorin: Nach Abschluß der einphasigen Juristenausbildung an der Universität Bielefeld 1990 mit Auslandsaufenthalten in Brüssel und Paris war die Autorin drei Jahre wissenschaftliche Mitarbeiterin am Lehrstuhl für Bürgerliches Recht, Handelsrecht, ausländisches und internationales Privat- und Wirtschaftsrecht von Prof. Kronke an der Universität Bielefeld. In den Jahren 1994-1998 arbeitete Bettina Grünwald als Mitarbeiterin und Leiterin von Rechtsabteilungen in verschiedenen Unternehmen. Seit 1998 ist sie als selbständige Rechtsanwältin tätig. Promotion 1997; die Dissertation wurde betreut von Professor Oehler an der Universität Bielefeld.
