Droit de cite, privation de droits civiques ou atimie, droit du mariage, ce dernier volume des Plaidoyers civils de Demosthene est riche d'indications sur le droit prive athenien. Les trois discours contenus dans cet ouvrage ne sont par ailleurs pas depourvus d'elements pittoresques ou realistes sur la vie quotidienne a Athenes. Le Contre Neera par exemple comprend un veritable tableau des moeurs dans la cite attique. Neera y est accusee d'avoir epouse un athenien tout en etant etrangere, contrevenant ainsi a la loi qui n'admettait de mariage de plein droit qu'entre personnes atheniennes. Son conjoint Stephanos affirme ne pas l'avoir epousee et pretend qu'elle ne vit avec lui qu'a titre de courtisane et non d'epouse. Dans le Contre Euboulides, le plaideur, nomme Euxitheos, defend son droit de cite contre son deme qui le lui refuse. La encore, le plaidoyer regorge d'elements relatifs a la vie familiere dans l'Antiquite: Euxitheos se justifie de la condition de ses parents, indigne de la citoyennete athenienne. Son pere, affirme-t'il, avait un accent parce qu'il avait ete fait prisonnier et vendu comme esclave. Le plaideur doit aussi justifier la condition de sa mere qui a ete nourrice et vendeuse de rubans sur le marche, metiers peu recommandables pour une femme de citoyen. Enfin, dans le Contre Theocrines, un certain Epichares denonce un sycophante nomme Theocrines qui exerce le metier d'accusateur professionnel malgre l'interdiction prononcee contre lui. Les trois discours sont presentes dans le present volume dans le texte original grec accompagne de la traduction de Louis Gernet. Chacun des plaidoyers est precede d'une notice qui aidera le lecteur a en saisir les enjeux juridiques et historiques. Enfin, dans les dernieres pages du volume, le lecteur trouvera un index des noms propres et des termes de droit utilises dans les plaidoyers civils de Demosthene.
