English summary: The right to an impartial judge is said to be a standard prerequisite of constitutional and procedural law. A problem, however, arises when grounds for disqualifying a judge are not discovered until after he has pronounced judgment. Judicial decisions and virtually all of the scholarly literature in continental European legal systems agree that a judge cannot be disqualified after the fact. Anglo-American legal sources disagree. Gregor Vollkommer is the first to deal with this topic dogmatically. In this work he provides a comprehensive solution to this problem. German description: Das Recht auf einen unparteiischen Richter gilt als Allgemeingut sowohl des Verfassungs- als auch des einfachen Verfahrensrechts. Die richterliche Unparteilichkeit garantiert die Zivilprozessordnung durch das mit zahlreichen Auslegungsstreitigkeiten belastete Ablehnungsverfahren der 42-48 ZPO. Ein besonderes Problem entsteht, wenn ein Ablehnungsgrund erst zu einem Zeitpunkt entdeckt wird, zu dem der Richter bereits sein Urteil gesprochen hat. Eine 'nachtragliche Richterablehnung' wurde bislang in Literatur und Rechtsprechung nahezu einhellig abgelehnt. Mit der vorliegenden Untersuchung arbeitet Gregor Vollkommer erstmals diese Thematik dogmatisch auf und fuhrt sie einer in sich geschlossenen Losung zu. Er gelangt zu dem Ergebnis, dass schon die Mitwirkung eines ablehnbaren Richters zu einem Verfahrensfehler fuhrt. Der in der unteren Instanz ubersehene Ablehnungsgrund kann daher auch noch im hoheren Rechtszug geltend gemacht werden. Wahrend der laufenden Instanz wird der Verfahrensfehler im Ablehnungsverfahren behoben. Ausgehend von dieser Erkenntnis ergeben sich zahlreiche Folgerungen fur die Ausgestaltung des Ablehnungsverfahrens, sein Verhaltnis zum Prozess in der Hauptsache und zu dem Rechtsmittelverfahren. Das abweichende Verstandnis der herrschenden Meinung erweist sich als ein Relikt des gemeinen Prozessrechts. Der Autor bedient sich eines weit ausholenden methodischen Ansatzes. Nach der Analyse des Verfassungsrechts, der Europaischen Menschenrechtskonvention und einer umfassenden rechtshistorischen Untersuchung des Ablehnungsrechts sichert er die gefundenen Erkenntnisse schliesslich rechtsvergleichend ab. Die auf diesem Weg gewonnenen Ergebnisse legen eine vollstandige Neukonzeption des geltenden Ablehnungsrechts nahe.
