English summary: Jan Rolin examines theories on the origin of the state in numerous modern writings which deal with the theory of the state. In doing so, he uses an approach based on the history of ideas which consistently implements those demands made by the so-called new history of ideas. In addition to those texts which were written by well-known authors, he analyzes innumerable less well-known authors. This study is not restricted to an overview of the development of the theories in the laws of nature and of the philosophy of law regarding the legitimation of the state and state authority in the 18th and 19th century; it also analyzes the development of topoi which are central to our modern political and social language, such as freedom, sovereignty, constitution, the people and the nation and the question of the state's purpose. German description: Worauf beruht der Staat bzw. staatliche Herrschaft? Wie sieht rechtmassige staatliche Herrschaft aus und wie ist ihr Umfang zu legitimieren bzw. zu begrenzen? Jan Rolin untersucht Theorien zum Ursprung des Staates in zahlreichen staatstheoretischen Schriften der Neuzeit. Er verfolgt dabei einen ideengeschichtlichen Ansatz, der die Forderungen der sog. Neuen Ideengeschichte - u.a. eine konsequente Ausweitung und Kontextualisierung der Quellenbasis - konsequent umsetzt. Die Analyse beschrankt sich nicht auf die Auswertung von Texten der grossen bekannten Autoren, sondern erfasst auch weniger bekannte. Inhaltlich beschrankt sich die Arbeit nicht auf einen Uberblick uber die Entwicklung der naturrechtlich-rechtsphilosophischen Lehren zur Legitimation von Staat und Staatsgewalt im 18. und 19. Jahrhundert, sondern widmet sich auch der Analyse der Entwicklung zentraler Topoi unserer modernen politisch-sozialen Sprache, etwa Freiheit, Souveranitat, Verfassung, Volk und Nation und der Frage nach dem Zweck des Staates. Dabei zeigt sich, dass sich das moderne Rechts- und Verfassungsstaatsdenken in der politischen Theorie Deutschlands erst am Ende des 18. Jahrhunderts durchzusetzen begann.
