Gegenstand der Arbeit sind die Aufklärungspflichten des Arbeitgebers im Arbeitsverhältnis. Bedarf an einer wissenschaftlichen Untersuchung besteht in mehrfacher Hinsicht: Zum einen fehlt es an einem gesetzlich normierten Tatbestand der spontan entstehenden und damit wenig transparenten Aufklärungspflichten. Zum anderen kristallisieren sich bei Sichtung von Literatur und Rechtsprechung nur vereinzelt systematische und dogmatische Ansätze heraus, so dass derjenige, der einer Aufklärungspflicht unterliegt, dies nur schwer erkennen kann. Insbesondere ist ihm eine antizipierende Prüfung dieser Frage kaum möglich. Inhalt der Arbeit ist daher die Erstellung eines möglichen Aufklärungstatbestandes und dessen Anwendung in den verschiedenen zeitlichen Ebenen eines Arbeitsverhältnisses. Die Autorin leistet mit dieser Arbeit einen Beitrag zur Klarstellung für einen besonders häufig anzutreffenden Lebenssachverhalt im anbahnenden und bestehenden Arbeitsverhältnis sowie bei dessen Beendigung.
About the Author: Marisa Hopfner, geboren 1978 in Mülheim an der Ruhr; Studium der Rechtswissenschaften an den Universitäten Greifswald und München; 2002-2004 Rechtsreferendariat beim Landgericht München II; 2005-2008 Rechtsanwältin beim Arbeitgeberverband der Versicherungsunternehmen; 2008-2009 promotionsbegleitende Tätigkeit in einer arbeitsrechtlich spezialisierten Kanzlei; 2010 Fachanwaltschaft Arbeitsrecht; 2011 Promotion an der Universität Erlangen-Nürnberg; seit 2006 ehrenamtliche Richterin am Sozialgericht; gegenwärtig Partnerin einer Münchner Kanzlei.
