Das nordrhein-westfalische Personalvertretungsrecht ist einem hohen Veranderungsdruck ausgesetzt. Gesetzlicher Handlungsbedarf besteht nicht zuletzt, seitdem ein Beschluss des Bundesverfassungsgerichts zum schleswig-holsteinischen Personalvertretungsrecht aus dem Jahre 1995 die Grenzen personalvertretungsrechtlicher Mitbestimmung enger gesteckt hat. Reformanstosse hat auch die Bull-Kommission zur Reform des offentlichen Dienstes gegeben. Gleiches gilt fur die Foderalismusdiskussion; von einer Abschaffung der Rahmengesetzgebung ware auch das Personalvertretungsrecht betroffen. Umso augenfalliger ist, dass das nordrhein-westfalische Per-sonalvertretungsrecht seit zehn Jahren keine Veranderung mehr erfahren hat. Seine Entwicklung ist vielmehr durch gesetzgeberischen Stillstand gekennzeichnet. Die Arbeit untersucht die Entwicklung des nordrhein-westfalischen Personalvertretungsrechts und analysiert die wesentlichen Einflussfaktoren fur die Gesetzgebungspraxis. Wahrend es bereits eine Anzahl rein rechtlicher Untersuchungen zum Personalvertretungsrecht gibt, ist den rechtspolitischen und rechtstatsachlichen Aspekten, die im Gesetzgebungsalltag von grosser Bedeutung sind, bislang nicht grundlegend nachgegangen worden. Methodisch werden neben dem Schrifttum vor allem Archivmaterialien, Ministerialakten und Gesprache mit Zeitzeugen als Quellen genutzt. Untersucht werden der Einfluss der Gewerkschaften und Verbande, die Bedeutung der Rechtsprechung und der anderen Personalvertretungsgesetze sowie des Betriebsverfassungsgesetzes fur die Entwicklung des Landespersonalvertretungsgesetzes Nordrhein-Westfalen. Nachgegangen wird auch der Frage, inwieweit die wissenschaftliche Diskussion und finanzielle Zwange die Gesetzgebungspraxis beeinflusst haben.
