English summary: It is undisputed that arbitration proceedings are only open to the persons required to decide the dispute. After having determined the legal basis and the extent of this principle under Swiss law, Philipp Ritz shows whether and to what extent the parties and all other participants are obligated to keep the existence of the proceedings and the information they have obtained confidential. He looks at the scope of protection of such information during and after closure of the proceedings, including challenge and enforcement proceedings before state courts. He also examines the legality of disclosing a piece of evidence to the arbitrators to the exclusion of the other parties. This book presents practical solutions for the busy practitioner and may also be of interest for arbitral tribunals sitting in civil law countries other than Switzerland. German description: Als einer der wichtigsten Vorteile der Schiedsgerichtsbarkeit wird die Nichtoffentlichkeit des Verfahrens genannt. Auf internationaler Ebene ist umstritten, ob sich daraus weitergehende Geheimhaltungspflichten ableiten lassen, wie Philipp Ritz einleitend aufzeigt. Nach einer Ubersicht uber die Grundlagen der Schiedsgerichtsbarkeit in der Schweiz, die rechtlichen Grundlagen des Geheimnisschutzes und die moglichen geheimhaltungspflichtigen Tatsachen im Schiedsverfahren widmet er sich dem Grundsatz der Nichtoffentlichkeit, der in der Schweiz wie in den meisten Staaten gesetzlich nicht geregelt ist. Er gelangt zum Schluss, dass die Nichtoffentlichkeit durch Gesetzesauslegung gewonnen werden kann. Danach untersucht der Autor, ob und inwieweit die Parteien, ihre Organe und Rechtsvertreter sowie die weiteren Verfahrensbeteiligten wie Sachverstandige, Zeugen und Schiedsrichter einer Geheimhaltungspflicht unterliegen. Was die Schiedsparteien betrifft, so sind sie seiner Meinung nach gesetzlich nicht zur Geheimhaltung verpflichtet. Die Annahme einer stillschweigend vereinbarten Geheimhaltungspflicht in der Schiedsvereinbarung lehnt er ebenfalls ab. Somit mussen die Parteien die Schiedsvereinbarung durch eine Geheimhaltungspflicht erganzen oder eine Schiedsordnung wahlen, welche die Geheimhaltung regelt, sofern ihnen diese wichtig ist. Abschliessend behandelt Philipp Ritz die Problematik des Schutzes von Unternehmensgeheimnissen im Beweisverfahren und die Rechtslage, wenn die staatlichen Gerichte bei einem Rechtsmittel- oder Vollstreckungsverfahren eingeschaltet werden.
