English summary: Tilman Repgen deals with the only question of general principle which is not normative or dogmatic and which was discussed intensely after the first draft of the BGB (German Civil Code) in 1888 and up to the resolution passed by the Reichstag in 1896: the question of the social challenge of private law. This is the first time that this discussion has been studied systematically, and the author's purpose is to establish what effect it had on the BGB. He shows that the previous concept of the social model is in fact outdated. With this study, Tilman Repgen makes a significant contribution to the discussion about the fundamental principles of German private law. German description: Im Anschluss an die Veroffentlichung des ersten Entwurfs eines burgerlichen Gesetzbuches fur das Deutsche Reich 1888 entstand in der juristischen Fachoffentlichkeit eine mitunter heftige Diskussion uber die soziale Aufgabe des Privatrechts, an der sich nicht nur Beruhmtheiten wie Otto Gierke, Heinrich Dernburg und Anton Menger beteiligten.Tilman Repgen untersucht den inhaltlichen Zusammenhang dieser Diskussion mit dem ersten Entwurf. Anschliessend behandelt er die Wirkung der Kritik auf das weitere Gesetzgebungsverfahren und schliesslich auf das BGB selbst. Die soziale Aufgabe des Privatrechts ist die einzige Frage nicht normativ-dogmatischer Art, die damals in ganz grundsatzlicher Weise behandelt worden ist. Die historische Analyse der Diskussion hat die Entwicklung der vier sozialen Topoi Gemeinschaftgedanke, Schutz des Schwacheren, soziale Freiheit und sozialpolitischer Ausgleich ermoglicht, mit deren Hilfe ein systematisches Verstandnis der verschiedenen kritischen Stellungnahmen zum Entwurf und den spateren Fassungen des Gesetzestextes gelingen kann.Die bisher ubliche Beschreibung des Sozialmodells des BGB erscheint im Hinblick auf diese Erkenntnisse als uberholt. Schon der erste Entwurf, wie auch erst recht die spateren Fassungen des Gesetzes, war weit sozialer, als es die im Ansatz ziemlich allein gebliebene Kritik von Otto Gierke ahnen lasst.Die historisch gestellte Frage beruhrt die Grundlagen des geltenden Privatrechts, da das nun gerade 100 Jahre in Kraft befindliche BGB nach wie vor seinen Kernbereich darstellt. Fur die Standortbestimmung des burgerlichen Rechts in der Gegenwart ist die Aufklarung dieser Grundsatzfrage des Gesetzgebers eine langst uberfallige Notwendigkeit.
