Studienarbeit aus dem Jahr 2021 im Fachbereich Soziale Arbeit / Sozialarbeit, Note: 1,3, Fachhochschule Münster (Sozialwesen), Veranstaltung: Arbeit: Eine multidisziplinäre Einführung, Sprache: Deutsch, Abstract: Diese Hausarbeit beschäftigt sich mit der Entlohnung von Menschen mit Behinderung in Werkstätten für Menschen mit Behinderung. Die Forschungsfrage lautet: Warum steht Menschen mit Behinderung der Mindestlohn nicht zu. Dies wird in dieser Hausarbeit thematisiert und untersucht. Die Arbeit erkundet die Definition von Behinderung, die UN-Behindertenrechtskonvention und ihre Entstehung, speziell Artikel 27 über Arbeit. Sie untersucht auch das Bundesteilhabegesetz, die WfbM in Nordrhein-Westfalen, einschließlich Zugang, Rechtsstatus, Bezahlung und zukünftige Aussichten. Deutsche Unternehmen sind aufgrund einer Beschäftigungsquote verpflichtet, 5% der Arbeitsplätze mit Menschen mit Behinderung zu besetzen. Dies gilt für Unternehmen ab 20 Mitarbeitenden. Erfüllen die Unternehmen diese Quote nicht, zahlen diese monatliche Abgabepauschalen an die Integrationsämter in Höhe von 125 bis 320 Euro pro unbesetzter Stelle oder sie geben Aufträge an die WfbM, sodass nur 50% der Ausgleichsabgabe gezahlt werden muss. Auf wirtschaftlicher Ebene ist die Vergabe von Verträgen an die WfbM für die Unternehmen ein lukratives Geschäft, die im Verlauf dieser Hausarbeit näher erläutert werden. Was für die Wirtschaft ein lukratives Geschäft ist, sieht für die beschäftigte Person in einer WfbM anders aus: umgerechnet erhält diese einen Stundenlohn von ca. einem Euro. Einen Lohn, von dem ein Mensch mit oder ohne Behinderung nicht leben kann und somit auf existenzsichernde Leistungen des Staates angewiesen ist. Ausgehend von einem Stundenlohn von einem Euro darf eine Einzelperson in Deutschland nicht in einem Arbeitsverhältnis arbeiten, da der Staat einen Mindestlohn festgelegt hat.
