Sollte es gegenwärtig tatsächlich Folter geben, dann nur im weit entfernten Guantanamo. Das Folterverbot scheint hierzulande Standard einer westlichen demokratischen Gesellschaft zu sein. So gestattet der genaue Wortlaut des Folterverbots aus Art. 3 EMRK, als einzige Bestimmung der Europäischen Menschenrechtskonvention, keinerlei Ausnahmen und Einschränkungen. Auf den ersten Blick gilt die Folter, jedenfalls in unserer modernen Gesellschaft, als inzwischen überwunden. Jedoch finden in der letzen Zeit immer häufiger Diskussionen darüber statt, ob das Folterverbot in Extremfällen legitimierbar sein kann. Auslöser über die Zulässigkeit von Folter ist der internationale Kampf gegen den Terrorismus. Bei den sogenannten 'ticking bomb' Fällen soll die Folter zu präventi- ven Zwecken eingesetzt werden, um potenzielle terroristische Anschläge rechtzeitig aufzuhalten. In Deutschland hingegen wurde die Folterdebatte nach einem Einzelfall der Kindesentführung entfacht. Bei dem Entführungsfall wurde dem Täter, der den genauen Aufenthaltsort seines Opfers kannte, lediglich die Folter angedroht um das in Lebensgefahr schwebende Kind zu retten. Anders als die früheren Foltermethoden aus dem Mittelalter oder aus der Zeit des Nationalsozialismus wird gegenwärtig wert darauf gelegt, dass bei dem Gefolterten keine äußerlichen Spuren sichtbar sind. Der Europäische Gerichtshof für Menschenrechte sah bereits in der Androhung von Gewalt gegenüber dem Kindesentführer einen Verstoß gegen das absolute Folterverbot aus Art. 3 EMRK6. Im Folgenden befasst sich diese Studienarbeit mit der Frage, was unter Folter nach Art. 3 EMRK
