Länder - Mittelalter, Frühe Neuzeit, Note: 1,0, Eberhard-Karls-Universität Tübingen (Institut für Geschichtliche Landeskunde und Historische Hilfswissenschaften), Veranstaltung: Hauptseminar: Urkundenlehre, Sprache: Deutsch, Abstract: "Eine Typologie der Privaturkunden existiert wegen der großen Heterogenität möglicher Inhalte und Formen nicht" (Thomas Vogtherr). Dies gilt jedoch nicht uneingeschränkt, und es gibt einige Teilmengen der Privaturkunden, für die die Forschung eine Typologie herauszuarbeiten versucht hat: etwa für das frühe Mittelalter mithilfe der Begriffe 'Carta' und 'Notitia', und zwar für denjenigen Teil der Privaturkunden dieser Zeit, den man annäherungsweise als 'Privaturkunden unter den Privaturkunden' beschreiben könnte. Es handelt sich bei den als 'Carta' und 'Notitia' typisierten Urkunden nämlich in der Regel um solche des privatrechtlichen Rechtsverkehrs. Diese auf den Rechtshistoriker Heinrich Brunner zurückgehende Typologie war nie unumstritten, ging jener doch von einer ungebrochenen Kontinuität des spätrömischen Urkundenwesens auch in den germanischen Reichen des Frühmittelalters aus. Zunächst soll eine allgemeine Darstellung der Formen und Merkmale der 'Carta' genannten Spielart der frühmittelalterlichen Privaturkunde im Vordergrund stehen und den ersten Teil der Arbeit bilden (Kapitel I und II). Nach einigen allgemeinen definitorischen Ausführungen sind hierbei die römischen Ursprünge dieser Urkundenform und ihre Ausprägungen bei Langobarden und Franken zu beleuchten, wobei jeweils auf äußere Merkmale wie beispielsweise Beschreibstoffe oder Schriftarten verzichtet wird. Daraufhin soll in den Kapitel III, IV und V anhand dreier Aspekte - namentlich Traditio cartae, 'Niedergang' der Carta und Verhältnis der Carta zur Notitia - die Forschungsdiskussion nachvollzogen werden, in der die Thesen Heinrich Brunners einer Revision unterzogen wurden.
