English summary: What does equality under criminal law mean? How is it possible to find the correct punishment for each crime? And why does the state inflict punishment? Using numerous modern writings on natural law and legal philosophy, Martin Reulecke studies the development of the relationship between the theory of the state, the concept of equality and criminal law. Based on the evaluation of a wide spectrum of small, relatively unknown sources and the contextualization of major authors such as Kant, Hegel and Feuerbach, the author is able to implement the methodical requirements of the new history of ideas. With regard to content, the author deals with the connection between the ideas in natural law and legal philosophy in relation to the basic principles of criminal law between approximately 1750 and 1850 and the model relationships which evolved during this time between the individual, society and the state, in particular with the history of the concept of equality. German description: Was bedeutet Gleichheit vor dem Strafgesetz? Wie findet man fur jedes Verbrechen die richtige Strafe? Und weshalb straft der Staat uberhaupt? Martin Reulecke untersucht anhand zahlreicher naturrechtlich-rechtsphilosophischer Schriften der Neuzeit die Entwicklung des Verhaltnisses von Staatslehre, Gleichheitsbegriff und Strafrecht. Durch die Auswertung eines breiten Spektrums von z.T. unbekannten kleineren Quellen und die Kontextualisierung 'grosser' Autoren wie Kant, Hegel und Feuerbach setzt er konsequent die methodischen Forderungen der 'Neuen Ideengeschichte' um. Inhaltlich widmet er sich dem Zusammenhang des naturrechtlich-rechtsphilosophischen Denkens uber die Grundlagen des Strafrechts im Zeitraum zwischen ca. 1750 und 1850 mit den in dieser Zeit entwickelten Modellen der Beziehungen zwischen Individuum, Gesellschaft und Staat und deren Veranderungen, insbesondere mit der Geschichte des Gleichheitsbegriffs. Dabei legt er auch die politischen Implikationen des Strafrechts offen. Es stellt sich unter anderem heraus, dass Naturrecht und Rechtsphilosophie bis zum Ende des Untersuchungszeitraumes von der Notwendigkeit, oder zumindest der Moglichkeit einer Berucksichtigung standischer Unterschiede im Strafrecht ausgingen.
