English summary: The denationalization of the law is one of the great challenges for legal scholarship today: the government as a traditional law-maker is being replaced, in an increasing number of fields, by private law-making agencies. The branches affected by this development include contract and corporate law, new areas such as sports law and Internet law, and international problems of regulation with which national legislators cannot adequately cope. The contributions to the present volume deal with the resulting problems. They are based on lectures presented to a joint meeting of the working groups for basic research, comparative private law as well as comparative commercial and business law of the Society for Comparative Law in Halle in September 2007. German description: Zu den grossen und aktuellen Herausforderungen an die Rechtswissenschaft gehort die Entstaatlichung des Rechts: Neben staatliche treten in zunehmendem Masse private Normsetzer. Betroffen sind davon klassische Rechtsbereiche wie das Vertragsrecht oder das Gesellschaftsrecht ebenso wie neuere oder neueste Rechtsmaterien (Sportrecht, Internetrecht). Vielfach treten private Normsetzer auf, wenn es um internationale Regelungsprobleme geht. Denn derartige Regelungsprobleme uberfordern den nationalstaatlichen Gesetzgeber. Gleichzeitig ist Staatlichkeit im supranationalen Bereich vielfach zu wenig ausgepragt, um als Basis fur traditionelle Normsetzung zu dienen. Private Normsetzung leistet in diesem Regelungsvakuum einen Beitrag zur Globalisierung des Rechts. Gleichzeitig erscheint sie aber auch als besonders problematisch. So stellt sich etwa die Frage der Legitimation. Im Ubrigen ist privat gesetztes Recht jenseits des Nationalstaats auch nicht in die herkommlichen systematischen und dogmatischen Strukturen des Rechts eingefugt. Und es kann die herkommliche Konzeption von Privatrecht in Frage stellen. Damit stellt sich etwa auch die Frage, inwieweit unser privatrechtliches Denken - bewusst oder unbewusst - auf den Staat bezogen ist.Der vorliegende Band behandelt die damit angedeuteten Probleme, die Gegenstand der gemeinsamen Tagung der Fachgruppen fur Grundlagenforschung, Zivilrechtsvergleichung sowie vergleichendes Handels- und Wirtschaftsrecht der Gesellschaft fur Rechtsvergleichung in Halle im September 2007 waren.
