Die Grundfreiheiten bilden die Stützpfeiler der gemeinschaftsrechtlichen Wirtschaftsverfassung (Art. 2 EGV). Der EG-Vertrag unterscheidet zwischen Warenverkehrsfreiheit (Art. 23-31 EGV), Arbeitnehmerfreizügigkeit (Art. 39-42 EGV), Niederlassungsfreiheit (Art. 43-48 EGV), Dienstleistungsfreiheit (Art. 49-55 EGV) und Freiheit des Kapital- und Zahlungsverkehrs (Art. 56-60 EGV), die jeweils Teilbereiche von Wirtschaftsaktivitäten mit grenzüberschreitendem Bezug schützen. Die Warenverkehrsfreiheit verbietet Ein- und Ausfuhrbeschränkungen sowie Maßnahmen gleicher Wirkung und sichert somit den freien Warenhandel. Die Arbeitnehmerfreizügigkeit räumt den Unionsbürgern innerhalb der EG Einreise- und Aufenthaltsrechte im Zusammenhang mit der freien Wahl eines Arbeitsplatzes ein. Die Niederlassungsfreiheit bietet den Selbständigen die Möglichkeit ihren Unternehmensstandort frei, nach optimalen Standortfaktoren, zu wählen. Die Dienstleistungsfreiheit schützt sowohl Dienstleistungserbringer als auch -empfänger bei grenzüberschreitender Inanspruchnahme. Die Kapitalverkehrsfreiheit ermöglicht die grenzüberschreitende Transaktion von Geld und Anlagewerten. Die Zahlungsverkehrsfreiheit bezieht sich auf die Erfüllung von Verbindlichkeiten.
About the Author: Sebastian Wagner, Master of Aviation Management, was born and raised in Germany. He studied at universities in Munich, Berlin and Austin/Texas where he successfully completed his degrees in Economics, Business Administration and Aviation Management. His specialist area of experience and knowledge is airport and airline management as well as human resources. He is also an experienced military air traffic controller, leader and lecturer. Until today Sebastian Wagner has published various aviation and marketing related publications.
