English summary: In this work, the author defines the bounds within which a successful cooperation between a tribunal and an expert assisting this tribunal has to take place. He examines in detail the functions of a judge and/or jury and the expert in the law of evidence, and proposes a solution for the problems of product liability which were the focus of the 1993 decision of the U.S. Supreme Court 'Daubert v. Merrell Dow Pharmaceuticals'. He clarifies the concept of the standard of proof in criminal cases with the help of Keith Lehrer's philosophical system developed in his book on 'Self-Trust'. He also defends the view that law and fact can be clearly distinguished from each other, but that there is no intrinsic quality that shows whether something is fact or law. It is the legal system itself which draws the borderline. German description: Welche Funktion hat der Sachverstandige nach geltendem Recht? Friedrich Toepel beantwortet diese Frage davon ausgehend, dass der Sachverstandige nur ein Beweismittel fur das Gericht ist. Seine Funktion kann durch die Verschachtelung von insgesamt drei Funktionen erklart werden: der Funktion des Rechtssystems fur die Gesellschaft, der des Gerichts fur das Rechtssystem und der des Sachverstandigen fur das Gericht. Das Rechtssystem stabilisiert die Verhaltenserwartungen der Gesellschaft, und das Gericht stabilisiert durch seine Autoritat das Rechtssystem, damit dieses seiner Funktion fur die Gesellschaft gerecht werden kann. Der Sachverstandige wiederum instruiert das Gericht bei der Sachverhaltserforschung, damit es seine Funktion im Rechtssystem wahrnehmen kann. Er instruiert nur, darf aber nicht in die Autoritat des Gerichts eingreifen. In diesem Zusammenhang pruft Friedrich Toepel, welche Kontrollmoglichkeiten Staatsanwaltschaft und Beschuldigter haben und weist insbesondere auf die Rechtsprechung des Europaischen Gerichtshofs fur Menschenrechte hin, die die Verteidiger in Deutschland bisher nicht genugend ausschopfen. Ein Hauptproblem fur die Verwertung des Sachverstandigengutachtens ergibt sich, wenn die Massstabe im Rahmen der Beweiswurdigung vage sind. Dann ist das Gericht zwar einerseits verstarkt der Beeinflussung des Sachverstandigen ausgesetzt, kann aber andererseits auch in gewissem Rahmen von dessen Gutachten abweichend entscheiden.Friedrich Toepel versucht, die Grenzen aufzuspuren, innerhalb derer der Sachverstandigenbeweis stattfinden darf, ohne dass der Sachverstandige eine Rolle einnimmt, die ihm nach geltendem Recht nicht zukommt.
