English summary: Should the defendant be relieved of liability for damages if some other hypothetical act or event would have led to the same result which occurred as a consequence of his actual conduct? 19th century German scholars established that damages should be assessed on the basis of the difference principle, which is in favor of relieving the defendant of liability in such a case. Since that time, the unsolved problem of hypothetical causation has been treated as a general damage issue rather than as a question of the reason for liability. In this work, Martin Gebauer develops a new approach. After outlining the various facets of this issue, which can be traced back to antiquity and were ignored for 150 years, he develops a solution which differentiates according to the specific reasons for liability. Some of these demand that the original right or obligation resulting from the action for damages be maintained, regardless of the hypothetical causes, and others allow hypothetical events to be taken into consideration. German description: Konnen hypothetische Ereignisse einen Ersatzanspruch ausschliessen? In Deutschland wird die Antwort darauf seit uber 150 Jahren im allgemeinen Schadensrecht gesucht. Die damals entwickelte Differenztheorie legt die Berucksichtigung hypothetischer Ereignisse durchaus nahe. Zur Vermeidung ungerecht erscheinender Ergebnisse wurden jedoch Ausnahmen und Fallgruppen gebildet, deren dogmatische Einordnung ebenso unbewaltigt blieb wie der umgekehrte Ausgangspunkt einer grundsatzlichen Irrelevanz hypothetischen Geschehens. Auch die Rechtsprechung sperrte sich gegen die radikalen Konsequenzen der Differenztheorie und nahm dabei Schadensgliederungen in gegenstandlicher oder zeitlicher Hinsicht in Kauf, die ihrerseits zu Systembruchen fuhrten.Martin Gebauer wendet sich gegen eine schadensrechtliche Einheitslosung und gegen die Flucht in Fallgruppen. Er zeichnet die Facetten der in die Antike zuruckreichenden Fragestellung nach, welche durch den allgemeinen Schadensbegriff verschuttet worden sind. Dabei entwickelt er fur das geltende Recht eine Losung, die nach Haftungsgrunden differenziert: Bestimmte Haftungsgrunde gebieten die Aufrechterhaltung eines objektiven Wertes im Ersatzanspruch auch insoweit, als das subjektive Interesse dahinter zuruckbleibt. Anderen entspricht gerade umgekehrt die entlastende Wirkung hypothetischer Ursachen. Martin Gebauer gliedert den normativen Gehalt der Rechtsfortsetzung in das System schadensersatzrechtlicher Prinzipien ein; dies dient entgegen verbreiteter Ansicht der Ausgleichsfunktion des Schadensersatzes.
