English summary: For what reasons and according to which criteria is a perpetrator responsible for unforeseen consequences of his criminal act? Christoph Burchard approaches these classical problems by illustrating the normativity of criminal intent and error of fact. To foreclose arbitrary judgments, he reconciles the doctrines of error of fact and criminal guilt. What is more, he substantiates these doctrines philosophically, firstly by reference to Max Weber's ethics of responsibility, and secondly by recognizing and thus emancipating the fellow human being who is attacked by the offender. Applying these principles to concrete cases, the author presents stringent and coherent solutions, which partially bolster, partially challenge, and partially restructure positions advanced by courts and academics. German description: Der Vorsatz des Taters kann entweder trotz eines Irrtums bejaht oder aber wegen eines Irrtums verneint werden. So begrenzt damit die irrtumsdogmatischen Antwortmoglichkeiten auch erscheinen mogen - die zugrunde liegenden Wertungen sind um ein Vielfaches komplexer. Immerhin gilt es zu klaren, fur welche unvorhergesehen Geschehen der Beschuldigte vorsatzdeliktisch verantwortlich sein soll. Doch was sind Grund und Grenze sowie Massstab einer subjektiven Zurechnung von Unvorhergesehenem zum Vorsatz?Christoph Burchard untersucht diese Grundlagenprobleme und fuhrt sie einer in sich geschlossenen Losung zu. Ausgehend von einer Systematisierung der verschiedenen Irrtumsfallgruppen - von den Klassikern wie der aberratio ictus zu den weniger bekannten Irrtumern wie dem uber Tatbestandsalternativen - stellt er die Normativitat des Vorsatzurteils in aller Deutlichkeit heraus. Um dieses Urteil nicht der Beliebigkeit preiszugeben, orientiert er die Irrtumslehre an der Schuld und erarbeitet daruber hinaus eine strafrechtsphilosophische Fundierung der Vorsatz- und Irrtumsdogmatik. Diese wird in Anlehnung an Max Webers Verantwortungsethik zum einen individualistisch begrundet, weist aber zum anderen auch dem konkret durch eine Tat angegriffenen Mitmenschen einen eigenen Stellenwert zu. Indem er diesen Ansatz fur die Falllosung fruchtbar macht, dogmatisiert der Autor fallgruppenubergreifend gultige Argumentationsmuster. Diese sichern die aus Rechtsprechung und Lehre bekannten Ergebnisse teils zusatzlich ab, stellen sie teils grundsatzlich in Frage und teils auf eine neue Basis.
