Jemand verfügt über das Wissen, ein bestimmtes Produkt herzustellen, sprich er besitzt das geistige Eigentum. Er kann mit seinem Wissen Geld verdienen, da das Produkt am Markt gefragt ist. Der Produzent sichert mit seinem Gewinn sein Überleben oder zumindest seinen Lebensunterhalt und, im Falle einer großen Pharmafirma, das Leben von zigtausend Mitarbeitern und deren Familien, sowie mittelbar über Steuern das Leben am Produktionsstandort. Mit diesem Produkt kann vielen Menschen das Leben erleichtert werden, aber sie können es sich nicht leisten. Um das Problem verständlicher und genauer zu analysieren hilft ein Blick in die Vergangenheit zu John Locke. Durch das Eigentum an seiner Person und der damit verbundenen "Investitionskraft/ Kraft seiner Arbeit" kann der Mensch, so Locke, sein Eigentum ausdehnen auf Bereiche, die vorher allgemeines Eigentum waren. Wenn er also einen Apfel aufhebt, überführt er ihn durch den Prozess des Aufhebens in sein Privateigentum. Durch seine investierte Arbeit erhält er ein Anrecht auf das von ihm geschaffene Werk, welches somit dem gemeinsamen Eigentum entrückt ist. Bei dem geistigen Eigentum mischt sich demnach die geistige Arbeit (die Entwicklung eines Medikaments beispielsweise) mit den notwendigen Rohstoffen zur Herstellung eines Produktes. Somit schafft der Mensch (in diesem Beispiel vermutlich ein Pharmachemiker) ein neues Produkt, welches ihm, so Locke, zusteht. Dieses Eigentum muss vom Staat geschützt werden. Eine absolutistische Willkürherrschaft, bei welcher der Herrscher jederzeit in das Eigentum der Bürger eingreifen kann, ist abzulehnen.
