Bachelorarbeit aus dem Jahr 2015 im Fachbereich BWL - Recht, Note: 2,3, SRH Hochschule Heidelberg, Sprache: Deutsch, Abstract: Die Bachelorarbeit setzt sich mit der krankheitsbedingten Kündigung als Unterfall der personenbedingten Kündigung auseinander. Zur arbeitsrechtlichen Einordnung des Krankheitsbegriffs versucht man, den medizinischen Krankheitsbegriff in eine juristische Norm abzuleiten, um einen besseren Zugang zu juristischen Sachverhalten beispielsweise in Gerichtsurteilen zu bekommen. Nach Klärung der Definition und Beschreibung der Problemstellung, folgt eine Betrachtung aktueller Statistiken zum Arbeitsmarkt, die erläutert und interpretiert werden. Danach wird zunächst ein Überblick gegeben, welche Arten der betrieblichen Kündigung es gibt, um dann den Bereich der personenbedingten Kündigung und insbesondere die Thematik der krankheitsbedingten Kündigung weiter zu untersuchen. Anschließend folgt ein kurzer Abriss über die richtige Erstellung einer gesetzeskonformen Kündigung, damit diese nicht etwa von der gekündigten Arbeitsvertragspartei angefochten werden kann. Hierbei wird besonders darauf eingegangen, welche Grundsätze bei der Erstellung einer Kündigung zu beachten sind und wie sich Fehler vermeiden lassen, die anschließend in ausführlichen Beispielen veranschaulicht werden. Des Weiteren wird die aktuelle Rechtsprechung des EuGH und des BAG untersucht. Die Ergebnisse der Arbeit werden im Fazit zusammengefasst, um dann auf die anfangs geschilderte Problemstellung zurück zu kommen und am Ende einen Ausblick für die Zukunft zu geben.
About the Author: Fabian ist Betriebswirt (FH) und Wirtschaftsjurist (LL.M.). Er wurde 1989 in Freiburg geboren. Er hatte schon immer ein Interesse daran, wie man Probleme im Unternehmensalltag professionell löst. Mit dieser Thesis möchte der Autor dabei helfen, Arbeitgebern und Arbeitnehmern eine bessere Herangehensweise der Thematik zu schildern.
