Stellt sich die Frage, warum das so ist. Die vorliegende Arbeit befasst sich mit dem Bereich der Folter und Marter als physischem Akt im Rahmen der Strafe oder als Teil eines Strafprozesses. Also ausschließlich jene Fälle, in denen eine Autorität, ob staatlich oder kirchlich, auf den Körper eines Delinquenten zugreift. Folter zwischen zwei Akteuren welche auf subjektiven Emotionen wie Hass oder Ähnlichem beruht, soll bewusst ausgeklammert werden. Ebenso die Schmerzen, die Menschen sich selbst beibringen. Gedacht sei hierbei an religiöse Geißelungen oder das moderne 'Ritzen'. Diese Geißelungen können als Selbstbestrafung des eigenen Körpers für Normverstöße betrachtet werden und bieten damit ein interessantes Feld für eine Körpersoziologische Untersuchung.Es geht also um die Untersuchung des Makrophänomens der Folter und Marter. Inwieweit 'Ethnische Säuberungen' und die Massenvergewaltigungen am Ende des zweiten Weltkrieges sowie im jugoslawischen Bürgerkrieg dazuzurechnen sind, ist eine Frage, die in dem Teil der Arbeit, der sich mit der sozialen Ungleichheit beschäftigt, zumindest kurz diskutiert werden soll. Michel Foucault befasst sich in seinem Werk 'Überwachen und Strafen', welches mit seinen Theorien die Grundlage dieser Arbeit bilden wird, mit der Entwicklung von der Marter hinzum modernen, ökonomisch orientierten Gefängnis. 'Es ist zu zeigen, dass die Strafmaßnahmen nicht einfach negative Mechanismen sind, sondern dass sie an eine Reihe positiver und nutzbringender Effekte geknüpft sind...1'.
