¿Por que vincular a Jose Castan Tobenas y a Antonio Vallejo-Nagera? ¿Que relacion guarda el derecho y la psiquiatria? En las siguientes paginas no queremos hacer un rastreo biografico de ambas personalidades tan importantes para el desarrollo y conservacion de la dictadura franquista. Este no es el proposito. Por parafrasear la noticia del ABC antes resenada sobre Azorin, por encima de disensiones, diferencias y partidismos, Castan y Vallejo fueron bienes comunes para la dictadura. Tan comunes que constituyeron el armazon teorico que legitimo la gubernamentalidad franquista. Fueron los dos grandes colaboradores y artifices juridico y psiquiatrico (es decir, artifices normativos) de la dictadura a la par que modelos de jurista y psiquiatra tanto para la dictadura como para la posterior democracia. Y lo hicieron desde sus condiciones materiales privilegiadas, desde sus importantes puestos durante la Segunda Republica: antes de la dictadura, Castan ya era Magistrado del Tribunal Supremo y Vallejo profesor-comandante de la Clinica Psiquiatrica Militar –llegaria a ser el primer catedratico de psiquiatria en la universidad espanola. Y ambos lucharon contra la Republica desde esos puestos, incluso convirtiendose en delatores de sus propios companeros. El Castan, como se conocio popularmente los varios mamotretos en que consistio su obra Derecho civil espanol, comun y foral, fue el texto basico para generaciones de juristas que se socializaron en su particular concepcion del derecho y que ha llegado casi hasta nuestro presente. De igual forma ocurrio con Lecciones de psiquiatria, de Vallejo, el manual de los estudiantes de medicina y su Gabinete de Investigaciones Psicologicas creado en 1938. Es sobre esto de lo que queremos detenernos aqui: en como de forma paralela la doctrina iuscivilista y la doctrina psiquiatrica conformaron, dibujaron, produjeron el armatoste normativo de la persona durante la dictadura. Se trata, en definitiva, de trazar una suerte de teo-antropologia juridica que nos muestre como se disenaron y ejecutaron los dispositivos biopoliticos durante el franquismo.
