Discussions of Part 1 of Book 5 Legal Issues in Education collaborate on such important issues as accommodating the needs of designated students, contract adherence, violation of the first amendment, and code of conduct. Discussions of Part 2 of Book 5 collaborate on policy violations in the workplace. This part discussion address a variety perspectives regarding the legal issues involved in the case of a teacher's alleged violation of current policy, resulting in his or her dismissal from his or her teaching position. Performing as an arbiter and facilitator, the governing board member and dean address whether the dismissal was justified or not and explains the part that community politics play in the decision-making process. As a plaintiff, student explains his or her view on the same issues, and a teacher-defendant attempts to defend him or herself after an evaluation of material presented by all stockholders in the case study. The plaintiff is expected to add substance by accumulating all written documentation and evidence regarding the student complaint. In response to the dean's request, the instructor also provides documented paperwork from his or her release from employment, in order to complete the due process and to present it in the second session of the hearing. Discussions of Part 3 of Book 5 collaborate on the importance and the steps of accreditation of private institutions. To recognize the guidelines and accreditation processes for private school, the National Private Schools Accreditation Alliance was contacted and requested information received. Further sections of this part provide analysis of the received material and a summary of the accreditation process. Two cases on accreditation were described, including summarizing positions of both plaintiff and defendant. Findings from research, presented lawsuits brought by higher educational institutions, state agencies, students, and teachers, are discussed. Further, the part will address the steps to avoid conflict in the future. Discussions of Part 4 of Book 5 collaborate on how the Supreme Court rulings affect education. The Supreme Court is the highest court of the land, which performs as the ultimate arbiter in all matters pertaining to the U.S. Constitution. That is why its rulings become the laws of the land that affect all similar situations in future cases. To explain the effectiveness of the Supreme Court rulings on education, four cases were selected. Stating Supreme Court rulings as results of its decisions in each case, this part addresses the implications of these rulings on educational institutions. This part also presents each case progression prior to appearing in the Supreme Court, and which cases, acts, or regulations were incorporated in Court decisions and rulings. Further, this paper discusses whether the Supreme Court decisions will affect an education for the long-term.
About the Author: Dr. Jane Goretskaya is President of Lifelong Approaches Consulting firm, Organizational and Educational Consultant, and Certified Advanced Faculty/Facilitator in University of Phoenix. She is the author of many articles and books, including Influence of Alternative Methods of Instruction on English Learners Achievement in Northern California School Districts (2007). Anatomy of the World of Education (2012), Anatomy of the World of Business (2013), Anatomy of Teaching English Learners (2013) and its series. Dr. Goretskaya holds two Master Degrees in Mechanical Engineering and Arts from the National University of Construction and Architecture and from Syracuse University, Syracuse, NY, and Doctoral Degree in Educational Leadership from Phoenix University, Phoenix, AZ. Dr. Jane Goretskaya has been a honored member of Cambridge Who is Who Association, American Publication Association, American Educational Research Association, CATESOL, Portrait Society of America, and Society of Illustrators.
