Diploma Thesis from the year 2003 in the subject Law - Philosophy, History and Sociology of Law, grade: B, language: Italian, abstract: Molto spesso si dice che il diritto romano sia un lontano antenato dei nostri attuali vigenti codici, ma il diritto romano e tutta la sua cultura non sono soltanto antenati della nostra moderna legislazione, essi sono le vere colonne dell'odierna cultura giuridica. Nelle pagine che seguiranno, cerco di analizzare i confusi avvenimenti di uno dei periodi più interessanti della storia romana e cioè il tardo impero in particolar modo con lo sguardo rivolto a quella che fu la figura più rilevante in questo periodo: Costantino il grande (312-337). Costantino non fu semplicemente un imperatore del tardo impero romano egli rappresenta nella storia una vera e propria boa da circumnavigare sapendo bene che una volta oltre passata non si sarebbe più potuto tornare indietro. Egli segnò una dicotomia assoluta tra ciò che fu l'età classica romana, l'età dei latini e di Roma e ciò che diventerà l'età bizantina. Costantino non solo decise di trasferire la capitale del mitico impero a Costantinopoli, quasi abbandonando la Roma imperiale che era stata madre del successo della cultura latina nell'allora mondo conosciuto, ma si spinse ben oltre creando, legiferando, riformando, convertendo; alla fine di questa immensa opera di ristrutturazione si avrà un impero nuovo. Una delle figure più rilevanti create nell'amministrazione da Costantino fu la figura del magister officiorum, la stessa traduzione in italiano ci aiuta a comprendere il significato e lo scopo di tale alto funzionario. Esso infatti inizialmente era soltanto il responsabile degli scrinia ma nel tempo arrivò ai vertici del potere imperiale entrando a far parte dei ministri del concistoro. Il concistoro era infatti un organo che serviva da ausilio all'imperatore per le sue più importanti scelte in tutti i campi politici.
