Für viele Menschen ein schwer erfüllbarer Traum. Dabei gibt es neben dem klassischen Weg des Erwerbs einer Immobilie auch andere, gemeinschaftsorientierte und kostengünstigere Lösungsansätze, Besitzer einer oder mehrerer Immobilien zu werden. Es handelt sich dabei um sogenannte Investmentfonds, in diesem Fall im Bereich der Immobilien. Das Grundprinzip eines Investmentfonds ist, dass sich viele Anleger zusammentun und bereits mit geringen Anteilen eine gemeinsame Investition tätigen. Investiert werden kann i.d.R. in den Markt für Immobilien, Kapital oder Rohstoffe. Die Kapitalanlageform des Investmentfonds ist mit rund 20.600 Mrd. Euro Vermögen weltweit führend. In dieser Arbeit geht es um die in Deutschland beliebteste indirekte Anlageform für Immobilien, dem Offenen Immobilienfonds. Nach einer kurzen Begriffserklärung und der darauffolgenden Bestimmung der Charakteristika Offener Immobilienfonds, werden die einzelnen Organe und ihre Funktionsweisen innerhalb des investmentrechtlichen Rahmens dargestellt. Dem Rechtsrahmen werden anschließend die aktuellen Anlagegrundsätze hinzugefügt. Im nächsten Kapitel der Arbeit folgt eine geschichtliche Hinführung zu der aktuell noch anhaltenden Krise auf dem Markt für offene Immobilienfonds. Es werden die Gründe für die Entstehung beleuchtet um daraus die Folgen bis zum heutigen Zeitpunkt abzuleiten. Auch wird im diesem Zusammenhang auf die während der Krise entstandene Notwendigkeit einer investmentgesetzlichen Änderung und der daraus entstandenen gesetzlichen Neuregelungen, zur Wiederstabilisierung des Marktes und dem Schutz der Anleger, eingegangen.
