Das europäische Kartellrecht setzt den rechtlichen Rahmen dafür, dass dieser freie Wettbewerb herbeigeführt oder erhalten wird, wenn es um Sachverhalte geht, die die Grenzen der Mitgliedstaaten überschreiten. Art. 3 g) EGV sieht vor, dass es Aufgabe der Europäischen Gemeinschaft ist, den Wettbewerb vor Verfälschungen zu schützen. Eine solche Verfälschung ist beispielsweise in der missbräuchlichen Ausnutzung einer marktbeherrschenden Stellung zu sehen. Somit bildet Art. 82 EGV, der diese missbräuchliche Ausnutzung verbietet, einen Kernbestandteil des europäischen Kartellrechts. Eine missbräuchliche Ausnutzung der marktbeherrschenden Stellung eines Unternehmens liegt in der Koppelung zweier Produkte, um künstlich den Absatz des gekoppelten Produkts zu erhöhen. Die Prüfung dieses Tatbestands war Teil des Verfahrens gegen den Softwarehersteller Microsoft vor der Europäischen Kommission. Der Fall Microsoft, der in der Öffentlichkeit große Beachtung fand, wurde am 22. Oktober 2007 - mit dem Verzicht Microsofts Rechtsmittel gegen das Urteil des EuG einzulegen - endgültig abgeschlossen. Die von der Europäischen Kommission auferlegten Abhilfemaßnahmen und das Bußgeld von etwa 497 Mio. Euro bleiben somit im Endergebnis bestehen. In der vorliegenden Arbeit wird zunächst auf die allgemeinen Grundlagen des Koppelungsgeschäfts gemäß Art. 82 EGV eingegangen. Der Schwerpunkt dieser Arbeit liegt allerdings in der Darstellung des Microsoftfalls, wobei besonderes der Missbrauch durch Koppelung dargestellt wird. Abschließend wird kurz auf die weitere Entwicklung nach dem Beschluss der Europäischen Kommission im Jahre 2004 eingegangen, bevor am Ende ein Fazit gezogen
