Das "Dritte Reich" und die DDR vor Gericht, Sprache: Deutsch, Abstract: Die vorliegende Arbeit beschäftigt sich mit den Phasen der französischen Strafverfolgungspolitik deutscher Kriegs- und NS-Verbrecher nach dem Zweiten Weltkrieg. Zu Beginn wird zunächst die Ausgangssituation Frankreichs nach dem deutsch- französischen Waffenstillstandsabkommen von 1940 geschildert. Die Herausbildung der französischen Widerstandsbewegung als Reaktion auf dieses Abkommen und die darauf folgende Partisanenbekämpfung der deutschen Besatzer forderte zwischen 1940 und 1945 unter der französischen Zivilbevölkerung zahlreiche Todesopfer. Nur durch die Erläuterung dieser vorangegangenen Ereignisse lässt sich das starke Bedürfnis der Franzosen nach einer strafrechtlichen Ahndung deutscher Kriegsverbrechen, die ab 1944 einsetzte und um die es im weiteren Verlauf der Arbeit gehen soll, begreifen. In ihrer Studie "Frankreich und die deutschen Kriegsverbrecher" von 2004 untersucht Claudia Moisel die französische Strafverfolgung nach dem Zweiten Weltkrieg und unterteilt dabei die französische Strafpraxis zur Ahndung von deutschen Kriegsverbrechen zeitlich in zwei Phasen. Auf die Unterschiede im Bereich der französischen Strafpraxis während dieser beiden Phasen, deren Zäsur Moisel auf den anglo- amerikanischen Auslieferungsstopp von 1947 zurückführt, wird im Hauptteil der vorliegenden Arbeit eingegangen. Die Frage, die sich in diesem Zusammenhang stellt und auf deren Beantwortung die vorliegende Arbeit abzielt, lautet: Warum veränderte sich die Strafverfolgungspolitik Frankreichs im Verlauf dieser beiden Phasen?
