English summary: Ina Ebert demonstrates that private penalties are certainly not unheard of in German private law. She shows that the necessity of implementing the standards of the Basic Law and German private law will increase the significance of private penalties in the future and makes a plea for viewing the Renaissance of the private penalty in German law not as a step backwards but rather as a conscious decision for a well-tried method for improving legal protection. In addition she calls for an open admission of the existence of penal legal institutions in German private law. In her opinion, this is necessary in the interest of a renewed convergence of legal dogmatics and legal practice and in order to find solutions for concrete legal problems which up to now had been thwarted by disguising private penalties as compensation payments. German description: Die Annahme, dass Privatstrafen dem deutschen Privatrecht fremd sind, ist nach wie vor weit verbreitet. Ina Ebert weist nach, wie wenig diese Vorstellung je der Rechtswirklichkeit entsprach und zeigt auf, wieso Privatstrafen kunftig wegen der Notwendigkeit, die Vorgaben des Grundgesetzes und des europaischen Privatrechts ins deutsche Privatrecht umzusetzen, noch weiter an Bedeutung gewinnen werden. Sie pladiert dafur, die Renaissance der Privatstrafe im deutschen Recht nicht als Ruckschritt zu begreifen, sondern als bewusste Entscheidung fur ein altbewahrtes Mittel zur Verbesserung des Rechtsschutzes, insbesondere im Hinblick auf immaterielle Rechtsguter. Zudem fordert sie ein offenes Bekenntnis zur Existenz ponaler Rechtsinstitute im deutschen Privatrecht: Zum einen im Interesse einer Wiederannaherung von Rechtsdogmatik und Rechtspraxis, zum anderen, um dadurch Losungen fur konkrete Rechtsprobleme zu ermoglichen, die bisher durch die Tarnung der Privatstrafen als Entschadigungszahlungen vereitelt wurden. Bestes Beispiel hierfur ist die oft als anstossig empfundene Diskrepanz zwischen der eher geringen Hohe von Schmerzensgeldern und den vielfach hoheren Betragen fur Personlichkeitsrechtsverletzungen, die sich ohne weiteres plausibel begrunden liesse, wenn der Schadensersatzcharakter des einen und der Privatstrafencharakter des anderen Rechtsinstituts starker betont wurden.
