Studienarbeit aus dem Jahr 2013 im Fachbereich Jura - Strafrecht, Note: 10, Freie Universität Berlin (Rechtswissenschaft), Veranstaltung: Seminar, Sprache: Deutsch, Abstract: Obwohl die Korruption sicher schon so alt wie die Menschheit selbst ist, hat dieser Straftatbestand in den letzten Jahren durch verschiedene Skandale in Politik und Wirtschaft enorm an Bedeutung gewonnen und das Bewusstsein der Deutschen dafür geschärft, dass es sich bei der Korruption absolut um kein Kavaliersdelikt handelt. Laut Polizeilicher Kriminalstatistik (PKS) gab es im Jahr 2010 in Deutschland 6141 registrierte Straftaten von Wettbewerbs-, Korruptions- und Amtsdelikten. Im Jahr 2011 ging diese Zahl auf 5241 registrierte Fälle zurück, stieg aber im darauf folgenden Jahr 2012 wieder um 8,5 % auf 5684 Fälle an. Die Dunkelziffer bei diesen Delikten wird jedoch auf ein Vielfaches höher geschätzt. Aus diesem Grund sind diese Zahlen leider auch wenig aussagekräftig. Der Schwerpunkt, der polizeilich bekannt gewordenen Straftaten der Korruption lag im Jahr 2012 zum dritten Mal in Folge im Bereich der Wirtschaft. Somit hat sich der Trend einer Verlagerung der polizeilich festgestellten Korruptionsfälle vom Bereich der öffentlichen Verwaltung in den Bereich der Wirtschaft verfestigt. Eine Analyse aller tatverdächtigen Vorteilsnehmer ergibt laut PKS, dass der überwiegende Teil von ihnen Sachbearbeiter oder Geschäftsführer einer privaten Firma oder eines Betriebes sind. Weitaus weniger Vorteilsnehmer lassen sich beispielsweise in Kommunalbehörden, beim Militär und im Gesundheitswesen finden. Vorteilsgeber waren in den letzten Jahren überwiegend Privatpersonen, aber auch Mitarbeiter oder Leiter eines Handwerk-, Bau- oder Dienstleistungsgewerbe. § 299 StGB wurde zur Bekämpfung der Korruption am 13.08. 1997 in das Strafgesetzbuch eingeführt und geht zurück auf § 12 des Gesetzes gegen den unlauteren Wettbewerb (UWG).
