Einleitung Die folgenden Seiten sollen einen Überblick über Raubkunst und Restitution während, nach und als Folge des Dritten Reiches verschaffen. Dabei möchte auf die erste völkerrechtliche Grundlage für Kulturgutschutz, die Haager Landkriegsordnung eingehen. Darnach soll ein kleiner Überblick darüber gegeben werden, wie zwischen 1935 und weit nach dem 8.Mai 1945 der Landkriegsverordnung zuwider gehandelt wurde. Kleine aktuelle Exkurse wird es zum Klimt-Fall der Galerie Belvedere, Österreich, der Sammlung Viktor Baldins, Russland und zum Quedlinburger Domschatz geben. Diese Fälle zeigen, auch über 60 Jahre nach dem Krieg konnte nicht alle Beutekunst restituiert oder ausfindig gemacht werden. Auch die vielen in der Presse erwähnten Fälle weisen daraufhin, dass noch immer Klärungsbedarf über die Herkunft von Kulturgut besteht. Das dieses Problem nicht nur dubiose Kunsthändler betrifft, sondern auch Museen mit hervorragendem Reputation, beweisen die aktuellen Fälle vom Brückemuseum, das ein Kirchner an die Alteigentümer restituiert hat und der Fall der Galerie Belvedere. Diese Fälle ziehen auch deshalb sehr viel Aufmerksamkeit auf sich, weil es meistens um sehr viel Geld geht. Es geht aber auch um Recht und Unrecht, die Grenzen verschwimmen bei Restitution und Beutekunst sehr stark. Auch vorhandene Gesetze sind nicht immer eindeutig auszulegen. Auch in den nächsten Jahren werden wohl weitere Fälle die Gerichte und die Medien beschäftigen. In der Neuzeit spricht man von drei Fällen systematischen, staatlichen Kunstraubes. Den Anfang machte die französische Revolution, direkt gefolgt von der Herrschaft Napoleons. Bis dahin hatte es kein anderer Herrscher verstanden, systematisch Kunstgegenständen aus den unterlegenen Ländern in das eigene Land abzuführen. Die Idee Napo
