English summary: Product advertising is not only socially valid but in fact desirable in a free market economy. However the suppliers' freedom to advertise should not conflict with consumer protection, in particular protection from deception, any more than can be tolerated. How can the consumer be protected from misleading product advertising? What provisions can be made in criminal law to punish inadmissible product advertising? Bernd Hecker examines the relationship between the protection against fraud in German criminal law and in Community law. German description: Produktwerbung ist in einer marktwirtschaftlichen Wirtschaftsordnung nicht nur eine sozialadaquate, sondern sogar eine erwunschte Tatigkeit. Die Werbefreiheit der Anbieter muss freilich dort ihre Grenzen finden, wo sie in nicht mehr tolerierbarer Weise mit Verbraucherschutzbelangen, insbesondere dem Schutz vor Irrefuhrung, kollidiert. In der deutschen Rechtsordnung wird die ausserste Grenze erlaubter Produktwerbung nicht nur von zivil- und verwaltungsrechtlichen, sondern auch von strafrechtlichen Bestimmungen markiert. In diesem Zusammenhang sind vor allem die Tauschungsschutzbestimmungen des Lebensmittel- und Wettbewerbsstrafrechts ( 17 Abs. 1, 52 Abs. 1 LMBG, 4 Abs. 1 UWG), aber auch der 'klassische' Betrugstatbestand ( 263 Abs. 1 StGB) interessant. Dem deutschen Verbraucherschutzrecht wird allseits attestiert, dass es im Vergleich zu anderen EG-Mitgliedstaaten ein sehr hohes, fast auf einsamer Hohe stehendes Schutzniveau gewahrleiste. Demgegenuber hat sich auf der Ebene des Gemeinschaftsrechts mittlerweile ein liberaler Tauschungsschutzstandard etabliert, der vom Leitbild eines 'informierten, aufmerksamen und verstandigen Durchschnittsverbrauchers' ausgeht.Bernd Hecker hat sich das Ziel gesetzt, die Probleme, die aus dem Spannungsverhaltnis zwischen nationalem Tauschungsschutzstrafrecht und Gemeinschaftsrecht resultieren, zu klaren. Die bestehenden dogmatischen Strukturen des deutschen Lebensmittel-, Wettbewerbs- und Betrugsstrafrechts betrachtet er im Lichte des Gemeinschaftsrechts kritisch und entwickelt sie gemeinschaftsrechtskonform fort. Die Europaisierung des Rechts bietet Anlass fur eine Neuinterpretation wettbewerbsrelevanter Straftatbestande, vor allem auch des Betrugstatbestandes. Tradierte dogmatische Strukturen des deutschen Strafrechts mussen vor diesem Hintergrund aufgegeben oder modifiziert werden.
