Mai 1949 wurde das Grundgesetz für die Bundesrepublik Deutschland in der damaligen Bundeshauptstadt Bonn offiziell verkündet. In Abstimmung mit den Alliierten hatten die Abgeordneten des Parlamentarischen Rates damit den Rahmen geschaffen "für die freieste Demokratie, die je auf deutschem Boden existiert hat." Im Grundrechtsteil findet sich unter Artikel 3,2 die Aussage "Männer und Frauen sind gleichberechtigt." Diese fünf sich in ihrer Formulierung recht unspektakulär ausnehmenden Worte markierten einen bahnbrechenden Fortschritt für die rechtliche Stellung der Frau und hatten in den Verhandlungen des Parlamentarischen Rates zu einer recht scharfen Kontroverse geführt. Niemals zuvor waren den deutschen Frauen derart weitreichende Rechte garantiert worden, wie in der Verfassung der jungen Republik. Im Grundgesetz war man damit einen entscheidenden Schritt weiter gegangen als in seinem verfassungsrechtlichen Vorgänger, der Weimarer Reichsverfassung von 1919, die Frauen zwar das aktive und passive Wahlrecht zugestanden hatte, ihre durch das Bürgerliche Gesetzbuch (BGB) fixierte niedere zivilrechtliche Stellung jedoch unangetastet ließ. Der Gleichberechtigungsartikel des Grundgesetzes - und hier liegt die entscheidende Verbesserung - erweiterte die Gleichstellung der Geschlechter auf alle Rechtsbereiche. Sie war unmittelbar geltendes Recht geworden, an das Gesetzgebung, Verwaltung und Rechtssprechung gebunden waren, das allerdings aus praktischen Gründen durch eine Übergangsregelung ergänzt wurde. Mit der angesprochenen verfassungs- und familienrechtlichen Stellung der Frau in der frühen Phase der Bundesrepublik Deutschland möchte sich diese Arbeit befassen.
