Im Mittelpunkt des Mietvertrags steht, anders als beim Kaufvertrag, nicht die Übereignung einer Sache, sondern deren zeitweilige Überlassung. Der Vermieter hat dem Mieter den Gebrauch der Mietsache während der Mietzeit zu gewähren, § 535 Abs. 1 Satz 1 BGB. Hierin zeigt sich die besondere Problematik des Mietvertrags, nämlich die Gebrauchsüberlassung. Der Abschluss eines Mietvertrags zielt somit nicht auf einen einmaligen Austausch zwischen Vermieter und Mieter ab. Vielmehr soll ein Verhältnis geschaffen werden, das den Mieter berechtigt, dauerhaft eine Sache in seinem Besitz zu nehmen. Im Gegenzug verpflichtet sich der Mieter zur Zahlung der Miete, § 535 Abs. 2 BGB. Der Mietvertrag stellt somit ein Dauerschuldverhältnis dar und zählt aufgrund der Konstellation der am Rechtsgeschäft Beteiligten zu den gegenseitigen Verträgen im Sinne der §§ 320ff. BGB. Die Bedeutung der Wohnraummiete in der Lebenswirklichkeit ist hervorzuheben.4 Grund hierfür ist nicht nur die wirtschaftliche Rolle - allein im Jahr 2016 wurde mit der Vermietung und Verpachtung von Grundstücken, Gebäuden und Wohnungen ein Umsatz in Höhe von fast 92,1 Mrd. Euro erzielt (ohne private Vermietung)-, sondern auch die soziale Komponente der Wohnraummiete. Hierbei wird der Mieter als schutzbedürftig empfunden. Schließlich ist die Wohnung Grundlage der Existenz. Folglich ist eine personale Leistungsbeziehung immanenter Bestandteil der Wohnraummiete. Das BGB soll dieser Situation Rechnung tragen. Besonders deutlich wird dies anhand der explizit auf die Wohnraummiete anwendbaren Normen der §§ 549-577a BGB. Der Grundsatz der Privatautonomie wird hier zugunsten
