Das Recht einer Gesellschaft ist seit langem Gegenstand soziologischer Unter- chung. Bemerkenswerterweise ist der Kern der juristischen Arbeit, die Arbeit am und mit dem Recht, um einen gegebenen Fall zu entscheiden, aber vergleichsweise wenig bis gar nicht untersucht worden. Was es gibt, sind Untersuchungen uber den Ablauf mundlicher Verhandlungen, auch der Umgang der Gerichte mit der Tat- chenfrage wurde untersucht, es fehlt aber fast vollstandig die Aufklarung der eige- lichen normativen Beurteilung von Tatsachen am Massstab des gegebenen Rechts, um damit einen Fall entscheiden zu konnen. Lediglich Studien von Rudiger La- mann und Bruno Latour widmen sich dem eigentlichen richterlichen Rechtsf- dungsprozess. Fur dieses Forschungsdefizit gibt es einsichtige Grunde, so den, dass das richterliche Beratungsgeheimnis die eigentliche Rechtsarbeit von der Beoba- tung durch Aussenstehende abschirmt; dieses rechtliche Beratungsgeheimnis wird in der deutschen Rechtswirklichkeit sehr strikt verteidigt, auch gegenuber wiss- schaftlichem Interesse (die verfassungsrechtliche Fragwurdigkeit dieses absoluten Vorrangs der richterlichen Unabhangigkeit vor der Wissenschaftsfreiheit ist hier nicht zu thematisieren). Zum anderen ist die eigentliche Rechtsfindungsarbeit d- wegen schwer zum Gegenstand wissenschaftlicher Untersuchung zu machen, weil sie sich zu einem guten Teil im Kopf der entscheidenden Richter abspielt, also nicht unmittelbar der Beobachtung zuganglich ist. Ausgehend von dem fur diese Arbeit entscheidenden Verstandnis von Recht als -Wissensordnung-, gewonnen aus der Auseinandersetzung mit der Max - ber schen Soziologie, wird der Symbolische Interaktionismus und die Neuere W- senssoziologie von Peter L. Berger und Thomas Luckmann herangezogen. Die Rechtspraxis wird als Losung von Wissensproblemen beschrieben."
