Bei einer Kündigung seitens des Arbeitgebers handelt es sich, da es sich hierbei um eine private Willensäußerung mit dem Ziel der Bewirkung einer Rechtsfolge in der Gestalt der Beendigung des Arbeitsverhältnisses handelt, um eine einseitig empfangsbedürftige rechtsgestaltende Willenserklärung1. Die Kündigungserklärung unterliegt daher den allgemeinen Vorschriften des Bürgerlichen Gesetzbuchs (§§ 104-185 BGB2) und entfaltet ihre Rechtswirkung erst dann, wenn sie dem Arbeitnehmer gemäß § 130 I zugegangen ist. Der Zeitpunkt, zu welchem das Kündigungsschreiben dem Arbeitnehmer zugeht, ist von entscheidender Bedeutung für den Bestand der Kündigung und die daran anknüpfenden weiteren Fristen. Dabei ist der Zugang sowohl für die Rechtzeitigkeit der Klageerhebung nach § 4 KSchG als auch für den Lauf der Kündigungsfristen nach § 622, sowie für den Lauf von Folgeansprüchen, wie etwa Arbeitslosengeld, ferner auch für die Tatsachenlage des § 1 KSchG, von Bedeutung. Der Zugangszeitpunkt ist auch dort für den Arbeitgeber von Relevanz, wo es um die Einhaltung von Ausschlussfristen, zum Beispiel § 626 II, oder bestehender öffentlich-rechtlicher Beschränkungen, wie etwa das Mutterschutzgesetz, geht. Das Recht des Zugangs von Willenserklärungen schafft Rechtssicherheit dadurch, dass die Risiken angemessen auf die Parteien verteilt werden. Durch Typisierung und Aufteilung nach Sphären von Einfluss und Verantwortung im Bereich des privaten Rechtsverkehrs3 kann eine solche Rechtssicherheit erst bewirkt werden, wobei die Risikoverteilung in einem Wechselspiel zur Rec
